Calibration Data and Intellectual Property

All calibration files, calibration tables, maps, parameters, strategies, definitions, configuration data, tuning methodologies, and other technical information created, modified, developed, or supplied by Backbone Horsepower (“Calibration Data”) constitute proprietary and confidential information of Backbone Horsepower, except to the extent such information is owned by a third party.

The customer is granted a limited, non-exclusive, non-transferable license to use Calibration Data supplied by Backbone Horsepower solely in connection with the vehicle, engine, ECU/PCM and/or TCU, or other application for which the Calibration Data was provided.

Unless expressly authorized in writing by Backbone Horsepower, the customer shall not copy, reproduce, distribute, disclose, share (verbally or visually), publish, upload, transmit, sell, sublicense, transfer, reverse engineer, extract, or otherwise make Calibration Data available to any third party, including other vehicle owners, tuners, tuning shops, service providers, online communities, file-sharing services, or calibration repositories.

Unauthorized disclosure, reproduction, distribution, or transfer of Calibration Data constitutes a material breach of these Terms of Service and may result in immediate termination of access to tuning services, technical support, calibration revisions, and any licenses granted by Backbone Horsepower; in addition, to any other material remedies available under applicable law.
